Acceptance of Terms
By accessing or using the StayAfrika platform (website, mobile application, or any associated service) operated by StayAfrika Technologies Limited, you agree to be bound by these Terms of Use. If you do not agree, do not use the platform.
These terms apply to all users, including guests, hosts, tenants, property managers, and visitors.
Eligibility
- •You must be at least 18 years old to create an account or use the platform
- •You must have the legal capacity to enter into a binding agreement under Nigerian law
- •You must provide accurate and complete information during registration
- •You may not create an account on behalf of another person without their explicit authorisation
Account Registration and Security
- •You are responsible for maintaining the confidentiality of your account credentials
- •You must notify StayAfrika immediately of any unauthorised access to your account
- •StayAfrika is not liable for any loss resulting from unauthorised use of your account
- •You may not create multiple accounts or use another person's account
- •Accounts found to be duplicates or fraudulently created will be suspended immediately
Platform Use Rules
You agree not to:
- •Use the platform for any unlawful purpose or in violation of Nigerian law
- •Post false, misleading, or fraudulent listings, reviews, or information
- •Harass, abuse, threaten, or discriminate against any other user
- •Attempt to circumvent the platform's payment system or conduct transactions outside of StayAfrika
- •Upload content that infringes the intellectual property rights of any third party
- •Use automated tools, bots, or scrapers to access or collect data from the platform without permission
- •Attempt to gain unauthorised access to any part of the platform or its infrastructure
- •Use the platform to facilitate illegal activities, including money laundering or human trafficking
Listings and Content
- •Hosts are solely responsible for the accuracy, legality, and quality of their listings
- •All listings must comply with StayAfrika's listing standards and Nigerian law
- •StayAfrika reserves the right to remove any listing that violates these terms
By posting content on the platform, you grant StayAfrika a non-exclusive, royalty-free licence to display and use that content in connection with the platform.
You represent that you own or have the right to use all content you post.
Bookings and Transactions
- •All bookings made through StayAfrika are subject to the host's listed terms, house rules, and cancellation policy
- •Payments are processed through Paystack and governed by Paystack's terms of service
- •StayAfrika is not a party to the agreement between guests and hosts — we facilitate the transaction
- •Disputes between guests and hosts should first be raised through the platform's support system
Prohibited Activities — Zero Tolerance
The following activities will result in immediate permanent account suspension and may be reported to Nigerian law enforcement:
- •Listing or occupying properties without legal authorisation or consent
- •Fraudulent identity representation or use of falsified documents
- •Sexual harassment or assault of any platform user
- •Any form of child exploitation
- •Knowingly facilitating illegal activity through a listing
Limitation of Liability
StayAfrika is a marketplace platform that connects hosts and guests. To the fullest extent permitted by Nigerian law:
- •StayAfrika is not responsible for the condition, safety, or legality of any listed property
- •StayAfrika is not responsible for the conduct of any user on or off the platform
- •StayAfrika's total liability to you for any claim is limited to the amount you paid in the 3 months preceding the claim
- •StayAfrika is not liable for indirect, incidental, special, or consequential damages
Indemnification
You agree to indemnify and hold harmless StayAfrika and its officers, directors, employees, and agents from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of the platform, your content, or your violation of these terms.
Termination
- •You may delete your account at any time through the Settings section
- •StayAfrika may suspend or terminate your account if you violate these terms
- •On termination, your right to use the platform ceases immediately
- •Provisions of these terms that by their nature should survive termination will remain in effect
Governing Law
These Terms of Use are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these terms shall be resolved in the courts of Nigeria.
Changes to These Terms
StayAfrika may update these terms at any time. We will provide at least 14 days' notice of material changes via email or platform notification. Continued use after the effective date constitutes acceptance.

Intellectual Property Protection
How StayAfrika handles IP and copyright
Overview
StayAfrika Technologies Limited respects the intellectual property rights of others and expects all users of the StayAfrika platform to do the same. This section explains what constitutes IP infringement on our platform, how to report it, and what happens when a report is made.
What Is Protected
Intellectual property protections on the StayAfrika platform cover:
- •Photographs and images uploaded to listings
- •Written descriptions, articles, and content published on the platform
- •Logos, brand names, and trademarks
- •Audio, video, and other creative works
StayAfrika's Own IP
The StayAfrika name, logo, platform design, user interface, and underlying technology are the exclusive intellectual property of StayAfrika Technologies Limited. You may not:
- •Use the StayAfrika name, logo, or branding without express written permission
- •Copy, reproduce, or distribute any part of the StayAfrika platform
- •Reverse engineer or attempt to extract the source code of the platform
- •Create derivative works based on the StayAfrika platform or content without permission
Note: Gold Tier hosts are granted a limited, revocable licence to use the StayAfrika-powered white-label platform under their own branding, subject to the Gold Tier subscription agreement.
User Content
By uploading photos, videos, descriptions, or any other content to StayAfrika, you represent and warrant that:
- •You own the content or have the legal right to use and publish it
- •The content does not infringe the copyright, trademark, or other IP rights of any third party
- •You have obtained all necessary permissions from individuals appearing in photographs or videos
You retain ownership of content you upload. By posting it on StayAfrika, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute the content solely in connection with operating the platform.
Reporting an IP Infringement
If you believe that content on the StayAfrika platform infringes your intellectual property rights, please submit a written complaint that includes:
- •Your full name and contact details
- •A description of the intellectual property right you claim has been infringed
- •The specific URL or location of the allegedly infringing content on the platform
- •A statement that you have a good-faith belief that the use is not authorised by the IP owner
- •A statement that the information in the complaint is accurate and that you are the IP owner or authorised to act on their behalf
- •Your physical or electronic signature

Our Response to IP Complaints
On receiving a valid IP infringement complaint, StayAfrika will:
- •Acknowledge receipt within 3 business days
- •Review the complaint and the allegedly infringing content
- •Remove or disable access to the content if we determine the complaint is valid, pending further investigation
- •Notify the user who posted the content that it has been removed and the reason why
- •Allow the user to submit a counter-notice if they believe the complaint is mistaken
Counter-Notice
If your content has been removed following an IP complaint and you believe the removal was in error, you may submit a counter-notice. The counter-notice must include:
- •Your full name and contact details
- •Identification of the content that was removed and its original location
- •A statement under penalty of perjury that you have a good-faith belief the content was removed by mistake
- •A statement that you consent to the jurisdiction of the Federal High Court of Nigeria
- •Your physical or electronic signature
Repeat Infringers
StayAfrika operates a repeat infringer policy. Users who are found to have repeatedly infringed the intellectual property rights of others will have their accounts permanently suspended.
Platform Abuse
StayAfrika's IP infringement process must not be used to make false or bad-faith complaints. Submitting a complaint you know to be false may expose you to legal liability.
Service Level Agreement
Our commitments to availability, support, and service quality
Purpose
This Service Level Agreement ("SLA") sets out the service commitments made by StayAfrika Technologies Limited to hosts and guests using the StayAfrika platform. It defines uptime targets, support response times, payout timelines, and the process for reporting service failures.
Platform Availability (Uptime)

Scheduled maintenance windows are excluded from uptime calculations. StayAfrika will provide at least 24 hours' advance notice of planned maintenance via platform notification or email.
Support Response Times

Payout Commitments
- •Host earnings are deposited into the StayAfrika wallet within 24 hours of a booking being marked as completed
- •Withdrawal requests to a Nigerian bank account are processed within 1–3 business days
- •In cases of dispute, payouts may be held pending investigation — the host will be notified within 24 hours of a hold being placed
Listing Review Commitments
- •New listing submissions will be reviewed by the Admin team within 48 hours of submission
- •Identity verification submissions will be reviewed within 48 hours
- •The host will be notified of approval, decline, or request for additional information via email and in-platform notification
Notification Delivery Commitments
- •Transactional notifications (booking confirmations, payment receipts, OTPs) are delivered in real time or within 2 minutes of the triggering event
- •Failed notifications are retried automatically up to 3 times before an alert is logged for manual review
Exclusions
This SLA does not apply to service disruptions caused by:
- •Force majeure events (natural disasters, government actions, nationwide network outages)
- •Third-party service failures (Paystack, SISSL, DigitalOcean)
- •User error or misuse of the platform
- •Scheduled and communicated maintenance windows
Breach of SLA
If StayAfrika fails to meet a committed service level, affected users may:
- •Log a formal complaint through the support system referencing the SLA breach
- •Request a service credit where applicable — StayAfrika may offer a credit to subscription hosts for significant uptime failures
StayAfrika is not liable for indirect or consequential losses arising from SLA breaches.
SLA Review
This SLA will be reviewed annually. StayAfrika reserves the right to update service commitments with 30 days' advance notice to users.
